KUALA LUMPUR, Wednesday 9 March 2011 (Bernama) -- Former forensic pathologist of Kuala Lumpur Hospital (HKL) told the High Court here that Mohd Saiful Bukhari Azlan had told her that he resisted a request to perform oral sex on the day the alleged sodomy took place.
Dr Razuin Rahimi said Mohd Saiful told her the matter when she took down his history at about 9pm on June 28, 2008, at the hospital.
She took almost 20 minutes to record Mohd Saiful's history at the One-Stop Crisis Centre (OSCC) of the HKL after having been briefed by investigation officer DSP Judy Blacious Pereira about Mohd Saiful's allegation that he was sodomised by Datuk Seri Anwar Ibrahim, she added.
She said three other doctors, Dr Khairul Nizam Hassan, Dr Mohd Razali Ibrahim and Dr Siew Sheue Feng, were not present during the history-taking and that she only briefed them after completing her tasks.
"Mohd Saiful also told me that he was sodomised by Anwar on June 26 approximately about 3.30pm and that he did not give his consent for the sexual act," Dr Razuin said during examination-in-chief by Solicitor-General II Datuk Mohamed Yusof Zainal Abiden.
The specialist, who is now attached with the Sungai Buloh Hospital, said Mohd Saiful told her that the sexual act took almost half-an-hour where the complainant also alleged that his breasts were fondled.
Asked to explain further on the entry she recorded on the "pro-forma form" (medical history form) where she had circled the word "penetration", Dr Razuin said it meant there was "full penetration" and that Mohd Saiful had also confirmed that ejaculation occurred during the act.
Asked why she did not record any reference about lubricant in the form as stated by Mohd Saiful in his testimony, Dr Razuin said she had recorded it in another piece of paper because the pro-forma form was for rape cases and that the HKL did not have specific forms for sodomy cases.
"The information was recorded on the paper which I later handed over to Dr Siew with notes recorded during the medical examinations carried out by the specialist," explained Dr Razuin.
Cross-examined by Karpal Singh on the meaning of "rectal attempted" as stated in the form, Dr Razuin explained that "rectal" was the inner part of rectum.
"It's sodomy even if the penetration did not reach the rectal area. That's the medical meaning of 'rectal attempted'," she said.
On another question, Dr Razuin confirmed that DSP Judy recorded her statement for the first time in January 2010 and the second time three weeks ago.
Anwar, 63, the Parti Keadilan rakyat advisor and member of parliament for Permatang Pauh, is alleged to have sodomised his former aide, Mohd Saiful, 25, at Unit 11-5-1, Desa Damansara Condominium, Jalan Setiakasih, Bukit Damansara, between 3.01pm and 4.30pm on June 26, 2008.
Meanwhile, Anwar's chief-of-staff Ibrahim Yaakob told the court that Mohd Saiful was not officially employed.
"He never was an employee but was a volunteer who take instructions directly from me," he said.
Questioned by Mohamed Yusof, he confirmed Anwar had attended a luncheon talk at an apartment belong to "Hassanuddin" on June 26, 2008.
However, he said that on that day Anwar had contacted him and told him he had left an envelope at his office at Section 15, Petaling Jaya and that he (Ibrahim) had asked Mohd Saiful to send the envelope to Anwar because he was busy on that day.
To another question whether he was aware that Mohd Saiful had tendered his resignation letter on June 27, 2008, Ibrahim said it was e-mailed to Anwar and that his boss forwarded it to him.
Asked by Mohamed Yusof what was the reason stated by Mohd Saiful for his resignation, Ibrahim said Mohd Saiful said that he could not perform his duties and wanted to be a pilot.
The hearing before justice Datuk Mohamad Zabidin Mohd Diah was adjourned to tomorrow, with DSP Judy scheduled to take his stand as the 25th witness before the prosecution closes its case.
